On March 11, 2018 the Student Representative Council passed the motion “suspending any consideration of any written notices that were received by the Chair from at least fifteen percent (15%) of the Union membership calling for the removal of the President or VP-Academic pending the resolution of the conflict between section 4(5)(1)(4) and sections 5(2)(4) and 5(3)(3). “

Following legal consultation, at the request of the Chair's office, a presentation was made to council in camera, on Sunday identifying inconsistencies within the Union Bylaws surrounding impeachment procedures specific to the bylaws mentioned above. 

After reviewing the Students’ Union Bylaws, the Student Representative Council has decided to take immediate steps to resolve the inconsistencies identified above, to provide clarity on this issue and remove all ambiguities. An Adhoc Committee has been created to address these concerns and these Bylaws will be passed through council prior to the end of this term. It should also be mentioned that this is the only method of impeachment that is currently suspended, all other consistent impeachment bylaws remain available.

 

Bylaws Under review:

Section 4, Sub-section 5 (Removal of Office), Article 1 (Procedures),

4. Removal of the President or VP-Academic Affairs will be considered after written notice has   been received by the Chair from either:

                        i.     Ten (10) members of Council.

                       ii.     At least fifteen percent (15%) of the Union membership.

                     iii.     The President or VP-Academic Affairs can then only be impeached by a two-thirds (2/3) majority vote of the Council by secret ballot.

  1. The President of the Union may  only be  considered  for  impeachment  by  the  Students' Union Representative  Council and  only  after  a  written  petition  for  impeachment  stating  cause,  signed  by  the (10) members of the Council has been received by the Chair of Council.  The Chair must call a meeting of  Council  within  five  (5)  days  after  receipt  of  such  a  petition.  The President may only be impeached by a 2/3 majority vote of Council by secret ballot.
